Welcome to TechCartel. These Terms & Conditions (“Terms”) govern your use of our website and the services provided by TechCartel. By accessing our website, submitting an inquiry, requesting a quotation, making a payment, or engaging TechCartel for any service, you agree to these Terms.

TechCartel is an India-based technology and digital services provider offering services including website development, mobile application development, custom software development, UI/UX design, API and third-party integrations, cloud and technical support, digital marketing, paid advertising, maintenance, and related technology services.

1. Services

The exact scope of services for each client will be determined through the applicable quotation, proposal, project document, invoice, email confirmation, or other written agreement.

Any feature, functionality, integration, design, service, or deliverable not specifically included in the agreed scope may be considered additional work and may involve additional charges and/or changes to the delivery timeline.

2. Quotations & Project Confirmation

Quotations provided by TechCartel are based on the requirements available at the time of estimation.

A project will be considered confirmed once the client accepts the quotation/proposal and, where applicable, pays the required advance or initial milestone payment.

If project requirements change after confirmation, TechCartel may revise the cost, scope, milestones, and estimated delivery timeline.

3. Payments

Payments must be made according to the milestones, schedule, or terms specified in the relevant quotation, proposal, or invoice.

Unless otherwise agreed in writing:

  • Advance payments are required before work begins.
  • Milestone payments must be cleared before proceeding to the next applicable project stage.
  • Final payment must be completed before final handover, deployment, source-code transfer, or release of production credentials, where applicable.
  • Third-party charges are separate unless specifically included in the quotation.

TechCartel may pause development, support, deployment, or other services if an outstanding payment becomes overdue.

4. Third-Party Services & Charges

Projects may require third-party products or services such as domain registration, hosting, cloud infrastructure, SSL certificates, payment gateways, SMS/OTP services, WhatsApp APIs, email services, Google Maps APIs, Apple Developer accounts, Google Play Console accounts, advertising platforms, plugins, software licences, or other external APIs.

Unless explicitly stated otherwise in writing, these charges are the client's responsibility.

TechCartel does not control third-party pricing, policies, availability, approval processes, service interruptions, account suspensions, or changes made by third-party providers.

5. Client Responsibilities

The client is responsible for providing accurate and timely information, content, images, logos, credentials, approvals, feedback, and other resources required to complete the project.

The client must ensure that materials provided to TechCartel can legally be used for the intended purpose.

Delays in receiving required information, feedback, payments, credentials, or approvals may affect the project timeline.

6. Project Timelines

Any project completion date or timeline is an estimate based on the agreed requirements and timely cooperation from the client.

Delivery timelines may change because of:

  • Changes in project scope;
  • Delayed client feedback or approvals;
  • Delayed payments;
  • Third-party API or service issues;
  • App Store or Play Store review processes;
  • Technical complications discovered during development;
  • Events reasonably outside TechCartel's control.

A delay caused by these circumstances will not automatically constitute a breach of the agreement.

7. Revisions & Change Requests

The number and scope of revisions will depend on the quotation or project agreement.

Requests that materially alter approved designs, workflows, functionality, integrations, or requirements may be treated as a change request.

Additional work may require a revised quotation and additional development time.

8. Intellectual Property & Source Code

Unless otherwise specified in writing, ownership of the final custom deliverables developed specifically for the client will be transferred after TechCartel receives all payments due for the project.

TechCartel retains ownership of its pre-existing intellectual property, reusable code, internal libraries, frameworks, utilities, development methods, templates, tools, know-how, and components that were not created exclusively for the client.

Third-party software, libraries, themes, plugins, fonts, APIs, images, and other assets remain subject to their respective licences and terms.

9. Portfolio Rights

Unless the client has requested confidentiality in writing or a separate confidentiality agreement prevents it, TechCartel may display publicly available aspects of completed work—including the client's name, logo, screenshots, project description, and links—as part of its portfolio, case studies, presentations, or promotional material.

Confidential business information, private credentials, source code, customer data, or other non-public information will not be intentionally published for portfolio purposes.

10. Website & Application Testing

TechCartel makes reasonable efforts to test projects before delivery or deployment.

Because software can operate across many combinations of devices, operating systems, browsers, networks, third-party services, and environments, completely error-free operation cannot be guaranteed.

Issues reported within an agreed support or warranty period that are directly related to the originally agreed functionality may be addressed according to the applicable project agreement.

New functionality, changes in requirements, third-party changes, or issues caused by external systems may be chargeable.

11. App Store & Play Store Submissions

Where TechCartel assists with publishing an application to platforms such as the Apple App Store or Google Play, final approval is controlled entirely by the respective platform.

TechCartel cannot guarantee approval, review time, ranking, continued listing, or acceptance of an application.

Any changes required because of platform policies may involve additional work depending on the nature of the changes.

12. Digital Marketing & Advertising

For digital marketing, SEO, social media, lead generation, Google Ads, Meta Ads, or similar services, TechCartel will perform the services according to the agreed campaign scope.

Advertising expenditure paid to platforms such as Google or Meta is separate from TechCartel's professional fees unless specifically included.

Marketing results depend on numerous external factors. Therefore, TechCartel does not guarantee a specific number of leads, sales, conversions, rankings, followers, revenue, or return on investment unless a particular measurable commitment has been expressly agreed in writing.

13. Confidentiality

Both parties should maintain reasonable confidentiality regarding non-public business, technical, financial, customer, and project information received during the engagement.

Confidential information will not be intentionally disclosed to unrelated third parties except where necessary to provide the services, required by law, or authorized by the relevant party.

14. Data & Credentials

Clients should provide only the credentials and access necessary for the project.

Where credentials are shared with TechCartel, reasonable measures will be taken to protect them. Clients are encouraged to change temporary passwords or revoke unnecessary access after project completion.

The client remains responsible for maintaining appropriate backups and security for systems under their control unless backup or security management is specifically included in an ongoing service agreement.

15. Maintenance & Support

Post-launch support, maintenance, server management, updates, backups, security monitoring, content updates, or feature improvements are not automatically included indefinitely.

Any free support period will be governed by the relevant quotation or project agreement.

After that period, continued maintenance or support may require a separate maintenance agreement or additional charges.

16. Cancellation & Refunds

Cancellation and refund eligibility will depend on the project's stage, work already completed, resources allocated, third-party expenses incurred, and the terms agreed for that project.

Payments for completed work, completed milestones, purchased third-party services, or resources already committed may be non-refundable.

Where a separate Refund Policy applies, that policy should be read together with these Terms.

17. Suspension or Termination

TechCartel may suspend or terminate services where there is:

  • Non-payment or repeated payment delay;
  • Illegal, fraudulent, abusive, or prohibited use of services;
  • Material violation of agreed terms;
  • Failure to provide information or cooperation necessary to continue the project.

Upon termination, any outstanding payment for work already performed remains payable.

18. Limitation of Liability

To the extent permitted by applicable law, TechCartel will not be liable for indirect, incidental, special, or consequential losses arising from the use or inability to use a website, application, campaign, third-party service, or other deliverable.

TechCartel is not responsible for failures caused by third-party hosting providers, APIs, payment gateways, app stores, advertising platforms, internet providers, external software, cyber incidents outside its reasonable control, or modifications made by parties other than TechCartel.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

19. Prohibited Use

Clients and website visitors must not use TechCartel's website, services, software, or infrastructure for unlawful activities, fraud, infringement, malware distribution, unauthorized access, harassment, or activities prohibited under applicable law.

TechCartel reserves the right to refuse services for projects involving illegal or prohibited activities.

20. Website Information

Information displayed on the TechCartel website is provided for general informational purposes.

Service descriptions, portfolio items, technologies, pricing, availability, and other information may be updated periodically without prior notice.

Website content does not constitute a binding project commitment unless incorporated into a written quotation, proposal, invoice, or agreement.

21. Privacy

Personal information submitted through the website or during a project will be handled according to TechCartel's Privacy Policy and applicable legal requirements.

Users should review the Privacy Policy alongside these Terms & Conditions.

22. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

Subject to applicable law, disputes relating to TechCartel's services or these Terms shall be subject to the jurisdiction of the competent courts in Sri Ganganagar, Rajasthan, India, unless otherwise agreed in writing.

23. Changes to These Terms

TechCartel may update these Terms & Conditions periodically to reflect changes in services, business practices, or legal requirements.

The updated version will become effective when published on the website unless otherwise stated.
